A contract between you and Apache Pizza is formed only upon our acceptance of your order, which is confirmed via an order confirmation notification sent to the email address or mobile number you have provided.

Apache Pizza reserves the right to refuse or cancel any order at our discretion, including where items are unavailable, where we suspect fraudulent activity, where there are errors in pricing or product information, or where we are unable to fulfil delivery to your specified address.

6.2 Pricing

All prices displayed on our website are in Euro (€) and are inclusive of Value Added Tax (VAT) at the applicable Irish rate, unless otherwise stated. Prices are subject to change without notice. The price applicable to your order will be the price displayed at the time you place your order.

Delivery charges, if applicable, will be displayed at checkout prior to the completion of your order. Minimum order values may apply for delivery, depending on your chosen location.

6.3 Payment Methods

6.4 Cancellations and Refunds

Given the perishable nature of food products, orders once accepted and confirmed may not be cancelled or returned in the ordinary course. However, if your order does not meet the standards you were reasonably entitled to expect — for example, if items are missing, incorrect, or of unsatisfactory quality — you are entitled to a remedy in accordance with the Sale of Goods and Supply of Services Act 1980 (as amended) and applicable Irish consumer law.

In no event shall Apache Pizza's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of our Services exceed the greater of (a) the total amount paid by you to Apache Pizza in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Euro (€100).

This limitation of liability applies whether the claims are based in contract, tort (including negligence), statute, or any other legal or equitable theory, and even if Apache Pizza has been advised of the possibility of such damages.

Nothing in these Terms shall limit or exclude Apache Pizza's liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Irish law, including the Liability for Defective Products Act 1991.


10. Indemnification

You agree to defend, indemnify, and hold harmless Apache Pizza, its affiliates, franchise partners, licensors, directors, officers, employees, contractors, agents, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:

  • Your use of our Services, including any orders placed through our platform;
  • Your violation of any applicable law, regulation, or third-party rights;

  • Your fraudulent, negligent, or wilful misconduct.

12. Allergen Information and Food Safety

Apache Pizza takes food allergen information seriously. In accordance with Regulation (EU) No 1169/2011 on the provision of food information to consumers, and the European Communities (Provision of Food Information to Consumers) Regulations 2014, we endeavour to provide accurate allergen information for all menu items.

However, our food is prepared in kitchens where allergens such as gluten, dairy, eggs, nuts, and other allergens are present. While we take precautions, we cannot guarantee that cross-contamination will not occur. If you have a food allergy, intolerance, or any dietary requirement, you are strongly encouraged to contact your local Apache Pizza store directly before placing an order. 13. Governing Law and Jurisdiction

15. Term and Termination

These Terms shall remain in full force and effect for as long as you use our Services or maintain an account with Apache Pizza. Apache Pizza reserves the right, in its sole discretion, to suspend or terminate your access to all or any part of our Services, with or without notice, for any reason, including but not limited to:

  • Your breach of any provision of these Terms;
  • Conduct that Apache Pizza, in its sole discretion, believes is harmful to other users, third parties, or the business interests of Apache Pizza;

No single or partial exercise of any right, power, or remedy shall preclude the further exercise of that or any other right, power, or remedy. The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies provided by law.

These Terms, together with our Privacy Policy and any other legal notices or policies published by Apache Pizza on our website, constitute the entire agreement between you and Apache Pizza with respect to your use of our Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, between you and Apache Pizza regarding the subject matter hereof.

Apache Pizza shall not be liable to you for any delay in or failure to perform any of our obligations under these Terms if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, government action or restriction, industrial disputes, failure of third-party suppliers or utilities, or any other cause beyond our reasonable control ("Force Majeure Event").

In the event of a Force Majeure Event, Apache Pizza will use reasonable efforts to notify you as soon as practicable and will endeavour to minimise any disruption to our Services. Our obligations will be suspended for the duration of the Force Majeure Event, and we will not be liable for any loss or damage suffered as a result.
